ORGANIZATIONAL SUMMARY:
The USF Privacy & Healthcare Civil Rights Compliance program (Privacy Program) is responsible for supporting and ensuring compliance by the USF Health community, USF Tampa General Physicians (USFTGP) and the USF HIPAA Covered Entity. The HIPAA Covered Entity is composed of the USF Health Morsani College of Medicine, and its constituent schools and departments (including its School of Physical Therapy and Rehabilitation Sciences); Taneja College of Pharmacy; USF Student Health Services; USF Health Neuroscience Institute (Home of the Johnnie B. Byrd, Sr. Alzheimer's Center); USF College of Behavioral & Community Sciences, Department of Communication Sciences and Speech Disorders; USF St. Petersburg campus Family Study Center, Infant Family Center; the advance practice providers under USF College of Nursing; USF Medical Services Support Corporation (MSSC); University Medical Service Association, Inc. (UMSA); USF administrative and operational units that support them including all physicians, other healthcare professionals, faculty, employees, trainees, students, volunteers and other personnel of the Covered Components and others serving in a Business Associate capacity on behalf of USF Health. The Privacy Program is also responsible for providing privacy compliance services to USFTGP. The Privacy Program is responsible for complying with all federal and state privacy laws, rules, regulations, policies and procedures. The Privacy Program establishes organizational policies and procedures required by law and the organization to prevent, detect, and correct conduct in violation of federal or state privacy laws and the privacy policies of the organization. The Privacy Program is responsible for HIPAA privacy education, monitoring, and reporting violations as required by law. The Privacy Program also reports privacy risks to the USF Chief Compliance Officer, USF Health leadership, USFTGP leadership and the respective boards.
ADDITIONAL INFORMATION FOR APPLICANTS:
Employees are expected to work on the USF Tampa campus on a regular established basis for the role. Examples of this schedule would be between 2 and 5 days per week in the office, depending on business needs.
POSITION SUMMARY:
The Privacy Specialist will assist the Privacy Officer, the Privacy Analyst, and the Privacy Investigator in investigating all allegations and reports of violations of federal or state privacy laws and internal privacy standard practices and procedures. The Privacy Specialist will be responsible for investigating reported incidents within CompliancePro (our privacy reporting system) to determine whether a privacy breach or violation of policy has occurred. The Privacy Specialist will also manage the privacy section within CompliancePro to make sure all privacy data is accurate and up to date and will be responsible for creating privacy reports on a monthly and annual basis. The Privacy Specialist will also work under the direction of the Privacy Analyst to assist with resolution of all breaches and privacy policy violations including working with leadership and human resources for the implementation of sanctions. The Privacy Specialist will also be responsible for responding to privacy questions; assisting with review, drafting, and managing privacy policies; managing the observer program; preparing privacy tips and meeting slides; keeping updated on privacy related law changes; and monitoring annual training is completed by team members.
RESPONSIBILITIES:
Investigates alerts that are generated by our monitoring software to determine whether the access by the employee to a patient's electronic medical record was permitted under HIPAA.
Conducts investigations of possible HIPAA privacy breaches or violations of policy to determine whether a breach occurred and whether a policy was violated.
Responsible for tracking the retraining completion dates of employees who have created an overlay. Manages the approval process for all observers in our clinical space. Assists with documentation of all business associate agreement information retained in our system
Prepares monthly, quarterly and yearly reports entailing all privacy monitoring activities and outcomes. Assists as needed preparing written slides or documents needed for upcoming meetings. Manages the review, drafting, finalization, and uploading of all privacy policies.
Responsible for maintaining employee and patient privacy. Responds to privacy related questions of our team members via our helpline telephones and emails. Assists with confirming all employees required to take privacy training complete such within specified deadlines. Maintains calendar of work assignments.
Performs other duties as assigned.
POSITION QUALIFICATIONS:
MINIMUM:
This position requires an Associate's Degree or equivalent and two (2) years of experience involving federal or state privacy laws, other legal field experience or work requiring access to an electronic medical record. College or other relevant post-secondary coursework may substitute for the experience requirement on a year for year basis.
FLSB1310 Equivalency:
2 years of directly relevant experience may be substituted for Associate's degree.
PREFERRED:
Seeking an individual with impeccable written and oral communication skills who has experience with conducting investigations and managing outcomes. Must be able to problem solve, be responsible for following up, and able to manage work load with minimal supervision. Must have prior HIPAA privacy law experience or experience working within an electronic medical record.
